Who pays compensation?
In South Australia, all registered vehicles are covered by Compulsory Third Party (CTP) insurance. This means the insurer – not the driver – usually pays compensation. As of July 2022, there are five CTP insurers: AAMI, NRMA, Allianz, QBE and Youi.
Time limits matter
You generally need to lodge a claim form within six months of the accident, and court proceedings within three years if it hasn’t been resolved. Different rules apply for children and there are steps you must take before going to court, so the safest option is to seek legal advice as soon as possible.
