Slip and Fall Compensation Claims: Do I Qualify?
Every year, we receive enquiries from people who have suffered injuries after a slip, trip or fall. Some injuries are relatively minor, while others can result in hospitalisation, surgery, ongoing treatment, significant time away from work and long term effect on daily life.
Not every accident will give rise to a compensation claim. In South Australia, claims of this nature are generally based on negligence, which means there must be evidence that another party owed a duty of care, failed to take reasonable care and that this failure caused the injury.
Before considering whether a claim may be available, it is important to understand the circumstances in which we can assist and the types of injuries that are most likely to justify legal action.
You should contact us as soon as possible if your injury was serious, particularly if you:
- have been left with a permanent injury or impairment;
- suffered multiple injuries;
- were taken to hospital;
- required surgery;
- have ongoing symptoms;
- Require ongoing medical treatment;
- are restricted in performing daily activities such as cleaning or gardening; or
- have been unable to work because of your injuries;.
These circumstances often indicate that a claim may be more significant and early legal advice should be obtained.
When are we unlikely to be able to assist?
Unfortunately, we may not be to assist if:
- You did not sustain permanent injury causing ongoing restrictions;
- You were unemployed or retired at the time of the accident;
- Your injuries did not prevent you from working;
- You have recovered quickly and do not require ongoing treatment;
- You are able to undertake daily activities like cleaning and gardening;
- The accident occurred while you were acting as a volunteer; or
- The slip and fall occurred on a local council footpath, reserve, park or other council-managed area.
If you are unsure whether your circumstances fall within these categories, we encourage you to contact us so we can discuss your situation.
